An advertising company has filed a lawsuit in US federal court against Elon Musk’s X Corporation for damages over Twitter’s name change.
A lawsuit filed by Florida-based advertising company X Social Media (XSM) accuses X Corporation of unfair competition and trademark theft.
XSM has said in its lawsuit that it has been using the X Social Media registered mark since 2016.
According to the company, it has suffered financial losses due to the X rebrand (Twitter’s name change) and the use of the X mark.
It’s not yet clear how strong XSM’s case is.
Legal experts speaking to the media said that due to the abundance of X trademarks, it is very difficult for any X-branded company to succeed in a case against another.
Now be it Elon Musk’s social media platform X or a company like X Social Media.
But this is likely the first case against Elon Musk’s company, which could face multiple lawsuits in the future over the use of the letter X because the letter is so commonly used in technology brands.
In fact, Microsoft and Meta Platforms have also incorporated X into their trademarks.
X Social Media has requested the court to stop Elon Musk’s company from using the name X and to compensate the financial loss.
No statement has been issued by X Corporation on this case so far.
